    Last year Frankston formerly Liberal now Independent MP Geoff Shaw was discovered to have been using his ministerial car and fuel card for his hardware store, picking up and making deliveries, business trips, he and his employees traveled as far as Albury and South Australia.
    The police investigation into this has concluded and he has been charged with 23 counts of obtaining financial benefit by deception and one charge of misconduct in public office, a summons has been issued for him to appear at Melbournes Magistrate Court on October 8th.
    So what happens if he is convicted? There goes the Liberals 1-seat majority? Then what?

    By the time this finally gets to court, it will be election time for all of us.   He has paid back money for the use of the vehicle, but now has the gall to plead not guilty at court.   How can you do that?

    Doesn't sound much different to Tim the hairdresser selling shampoo out the back of a Commonwealth car.  (How did he get the keys to the car??)   The red head did well to keep this out of the news before the election.   Daniel Andrews should not throw too many stones at Napthine, they have a habit of coming back at you.

    It's gunna get dragged out for as long as they can to avoid the possibility of a hung Victorian lower house; apparently it's not a forgone conclusion that he'll have to leave his seat if he's found guilty and you can be sure that Denis Napthine has been getting top shelf legal advice about what to do under a range of scenarios.  We'll just have to wait and see what happens -

    As per my conversation with Valvegear on another thread about corruption, you need to throw the book at people who get caught red-handed doing this sort of thing because it's very rare to actually catch people out and subsequently prove intent to defraud.  He was only in parliament for less than a year when the alleged offences happened... and as per other politicians caught out in NSW doing the wrong thing he's gone on record saying that (somehow) he's the victim in all this. Ahem!

    He's started the ball rolling by requesting trial by Magistrate. I think his legal team is having conniptions at the idea of having to defend in front of a County Court jury.
    As don_dunstan just said, it's not a foregone conclusion that a guilty verdict means he loses his seat. That only happens automatically if a member is guilty, and sentenced to five years of more in one of Her Majesty's guest houses.

    a) he may yet be charged

    b) the claims were unsubstantiated

    c) perhaps worry about your glorious leader's taxpayer funded photo opportunities

    d) The money was hurriedly paid back by Julia.

    e) The whole thing was hushed up because she was Prime minister at the time.

    f) The glorious former Leader was enjoying his taxpayer funded photo opportunities and nothing was permitted to take the shine off those.

    If (d) is correct, the whole thing is no different from a number of politicians from any or all parties who have, for years, used expenses incorrectly, been exposed, and paid the money back to end it all.

    If (e) is correct, the media must have been having a collective "Be nice to Julia" day. . . not something that happened very often, if at all.

    There have been a few posts along the line of " Well, Bloggs did it when Labor was in office, and he claimed more than Blaggs has now". This is schoolyard stuff - your mob did it, so don't complain about mine. I think we should all be complaining vociferously about the whole lot of them who rort expenses, regardless of their affiliations.

    Except that this recent storm in a teacup over Abbott is not being criticised by the opposition as Albanese seems to think that there is little wrong with it. That and the fact that they have also been caught out.

    I thought nick Zenophon had the best take on it, if it is not justified, make them pay back twice the amount out of their own pockets.

    No argument there. The problem is that the pollies believe that "entitlement" is the key word; justified or not.

    I can use my psychic powers to predict a non-custodial sentence.  Geoff Shaw's legal team will be arguing what an outstanding citizen he is and that it's a first time offence - I would be astonished if he actually got jail.  My personal opinion is that the way he brazenly used the work car and petrol was pretty disgusting and contemptuous; the fact you hardly ever catch white collar criminals means they should throw the book at him to set an example...

    If he gets less than 5 years imprisonment (and that's not likely) then he is able to remain the member for Frankston - until the next election anyway.

    Earlier, taxi licence holder Leo Mauro, 80, said Mr Shaw had thrown punches at more than one protester who approached him at the entrance to Parliament House, and landed a punch on a fellow protester that left his face bloodied.
    ‘‘He punched and pushed everybody who tried to talk to him,’’ Mr Mauro said.

    ‘‘We are peaceful people, what’s the matter with him? We are old people, most of us over 70, we should not be treated like this.’’

    I'm no great wrap for Shaw either, but I agree with The Blacksmith.  Had I been in Shaw's shoes, I would have clouted the bloke too.

    I see the taker of the of so damning footage even states 'I got him punching back'. I also note the news services were referring to the guy as 'elderly' well he ran up the steps several at a time he couldn't have been that elderly. Copped what he deserved I reckon.

    The 'elderly' guy is apparently 80 years old and I must say, despite the fact that I don't like Geoff Shaw, I agree with others here that the footage appears to justify the response.  I don't have a lot of sympathy for these taxi license holders, they've seen the value of their licenses sky-rocket over the years and now the government wants to give out more they're going ballistic.   In my opinion, too bad... it's a taxi license, not a speculative investment vehicle.

    Mr Shaw has just tossed the cat nicely among the pigeons. He was ruled out of order by the Speaker, and responded by saying that he had no confidence in the Speaker or his rulings. Backed up ( obviously ) by Labor, this means that the Speaker does not enjoy the confidence of the House. A senior Liberal was quoted as saying that the current Speaker "would be gone by Thursday."

    There's a lot of stuff happening in state parliament at the moment.  Geoff Shaw also voted against the government for the first time; his relationship with Napthine has taken a turn for the worse due to the Liberal fund-raiser on the weekend where a comedy skit by Nick Giannopoulos was very unflattering about Geoff Shaw...  Shaw tried to laugh it off in the media but you could tell he was very annoyed.

    It's not the only excitement in our parliament at the moment.  Apparently there's also a push to get rid of Daniel Andrews because the unions want to put someone who's more favourable to them in that position; I don't know much about Daniel Andrews but given the latest opinion polls perhaps they should leave him where he is - they finally appear to be making inroads.
